1. Agreement and Marketplace terms

By using JetEncode, you agree to these terms and to the terms presented with the product on AWS Marketplace. If a term in the applicable AWS Marketplace order, standardized contract, or private offer conflicts with this page, that Marketplace agreement controls for the purchased or subscribed product. AWS is not a party to these JetEncode terms.

This website page is not a substitute for selecting an EULA or standardized contract in the AWS Marketplace product submission.

2. License

Subject to these terms and the applicable Marketplace agreement, JetEncode grants you a limited, non-exclusive, non-transferable right to run the software for your internal business purposes during an active entitlement. You may make only the copies created as part of normal authorized AWS deployment, backup, and recovery processes.

3. Acceptable use

You may not use JetEncode unlawfully; interfere with its security or integrity; remove proprietary notices; distribute or resell the software except where an applicable agreement expressly permits it; or attempt to gain unauthorized access to systems or data. Restrictions apply only to the extent permitted by applicable law.

4. Your responsibilities

You are responsible for your AWS account, permissions, security groups, storage, backups, source-media rights, encoded outputs, and compliance with laws that apply to your use. You must test outputs before relying on them in production and must not provide JetEncode with credentials or access to your instance unless explicitly arranged for a support case.

5. Fees and third-party services

The current JetEncode software charge is $0. AWS infrastructure and other third-party services may create separate charges governed by their providers. JetEncode does not control AWS availability, billing, or changes to AWS services. See the refund policy for cancellation guidance.

6. Updates and support

We may update the software, documentation, supported configurations, and these terms. Material term changes apply prospectively from the posted effective date unless law or an applicable Marketplace agreement requires otherwise. Support is provided under the support policy.

7. Ownership

JetEncode and its licensors retain all rights in the software, website, documentation, branding, and related intellectual property. These terms do not transfer ownership. Third-party and open-source components remain subject to their respective licenses.

8. Disclaimers

To the maximum extent permitted by law, JetEncode is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee uninterrupted or error-free operation, preservation of data, or any particular performance result.

9. Limitation of liability

To the maximum extent permitted by law, JetEncode will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption arising from use of the product. Any liability that cannot lawfully be excluded remains limited only to the extent permitted by applicable law and the controlling Marketplace agreement.

10. Suspension and termination

You may stop using JetEncode at any time. We may suspend support or terminate rights under these terms for a material breach, unlawful use, or a security risk, subject to any controlling Marketplace agreement. Provisions that by their nature should survive will survive termination.
